Terms of Service

These terms govern your use of skywavemarketing.net and any services provided by Sky Wave Marketing ("SkyWave," "we," "us"). By using this site or engaging our services, you agree to these terms.

Services

SkyWave provides digital marketing services for local businesses, including advertising management, content, lead generation systems, CRM setup, automation, and website work. The specific scope, deliverables, and pricing for any engagement are set out in the proposal or agreement we provide you before work begins.

Engagements and billing

Unless your agreement says otherwise, services are billed monthly in advance and run month-to-month — there are no long-term contracts, and you may cancel before your next billing cycle. One-time setup fees and project fees are due as invoiced. Advertising spend on platforms such as Google and Meta is always paid by you directly to the platform and is separate from our fees.

Client responsibilities

You agree to provide timely access to the accounts, assets, and approvals needed to perform the services, and to ensure that any materials you supply (logos, photos, offers, claims) are accurate and yours to use.

Results

Marketing outcomes depend on many factors outside any agency's control — your market, your offer, your follow-up, platform behavior, and seasonality among them. Case studies and testimonials on this site describe real past engagements; they are not a promise of your results, and we do not guarantee specific revenue, lead volume, or ad performance.

Intellectual property

You retain ownership of the materials you provide. Upon full payment, deliverables created specifically for you (ad creative, landing pages, content) are yours. We retain the right to use our general know-how, tools, and non-confidential work samples in our portfolio unless you ask us not to in writing.

Confidentiality

Each party agrees to keep the other's non-public business information confidential and to use it only for the engagement.

Limitation of liability

To the fullest extent permitted by law, SkyWave's total liability for any claim arising out of the services or this site is limited to the fees you paid us in the three months before the claim arose. We are not liable for indirect, incidental, or consequential damages, including lost profits.

Third-party platforms

Our services rely on third-party platforms (Google, Meta, GoHighLevel, and others). We are not responsible for platform outages, policy changes, account reviews, or decisions those platforms make about your accounts or ads.

Termination

Either party may end a month-to-month engagement effective at the end of the current billing period with written notice. We may suspend or end services immediately for non-payment or misuse.

Governing law

These terms are governed by the laws of the State of California. Any disputes will be resolved in the state or federal courts located in California.

Changes

We may update these terms from time to time; the effective date above reflects the latest revision. Continued use of the site or services after changes means you accept the updated terms.
